Terms of Use and Privacy Policy
Welcome to the Broadway Wine Club website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions, which together with our privacy policy govern your relationship with the Broadway Wine Club in regards to this website.
Terms of Use
The content of the pages of this website is for general information and use only. It is subject to change without notice.
Neither the Broadway Wine Club nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. Users acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
Any use of information or materials from this website is entirely at the user’s own risk, for which we shall not be liable. It shall be the responsibility of all users to ensure that any products, services or information available through this website meet any specific requirements.
This website contains material which is owned by or licensed to the Broadway Wine Club. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
All trademarks reproduced in this website which are not the property of, or licensed to, the Broadway Wine Club are acknowledged on the website.
Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offence. From time to time, this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that the Broadway Wine Club endorses the website(s) and the Broadway Wine Club accepts no responsibility for the content of the linked website(s).
Your use of this website and any dispute arising out of such use of the website is subject to the laws of the United States.
Alcoholic Beverages
All alcoholic beverages are sold in California where title passes to the buyer. Broadway Wine Club makes no representations to the legal rights of anyone to ship or import wines into any state outside of California. The buyer is solely responsible for the shipment of alcoholic beverages and products.
By placing an order, you authorize Broadway Wine Club to act on your behalf to engage a common carrier to deliver your order to your address of record. Wines may only be sold and delivered to persons who are at least 21 years of age. In placing an order, you represent to us that you are at least 21 years of age.
The person receiving the wine will be required to show identification proving they are of legal age to do so. Due to the legal restrictions on wine and other alcoholic beverages, we are only permitted to ship to certain states. We do not offer shipping outside of the United States. Wines purchased from the Broadway Wine Club are not for resale, and are for personal consumption only.
Credit Card Charges
Orders are by credit card only. We accept Visa, MasterCard, American Express, and Discover.
Shipping
Due to the ever-changing nature of wine shipping laws, the list of states that the Broadway Wine Club can ship to is subject to change. If our website does not currently allow for shipment to your state, please contact us at info@broadwaywineclub.com to discuss potential options.
Shipping Costs
When placing an order from the Broadway Wine Club, the purchaser is responsible for providing an accurate delivery address and delivery timing. Members of the Broadway Wine Club are responsible for all fees associated with returned packages or reshipping of wines. For that reason, the Broadway Wine Club highly recommend shipping wine to a business address as alcoholic beverages cannot be left without the signature of someone over the age of 21.
Shipping Risks
Wine is a perishable product that is sensitive to extreme temperatures; hot humid summer and cold winter weather may adversely affect the condition of wine during shipment. The Broadway Wine Club is not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment.
It is the responsibility of the purchaser to provide accurate address and contact information when ordering. All fees related to re-routing and returned shipments are the responsibility of the club member.
The purchaser is responsible for selecting ship dates that are conducive to safe transport and delivery of wine. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.
The Broadway Wine Club reserves the right to delay or expedite any/all shipping orders in order to provide safe temperature conditions for wine shipments.
Returns & Cancellations
We believe in our wines and stand firmly behind their quality. We will replace or refund the cost of any bottle of wine that is flawed or that the customer finds unsatisfactory. We ask the customer return the unfinished portion of the original bottle for replacement. By law, the Broadway Wine Club cannot accept returns of alcoholic beverages unless the product is corked, or flawed. The Broadway Wine Club is also unable to accept return of wine that was damaged due to adverse weather conditions during shipment, or wine that is ordered in error. Please send an email to info@broadwaywineclub.com to arrange for the return of corked or flawed wine.
Once the wine is received and the quality issue has been verified, we will refund your credit card account for the cost of the wine, less shipping and handling. Please contact the Broadway Wine Club at info@broadwaywineclub.com for return instructions.
